Rohit Erande.  ©, A) INTRODUCTION :   In Indian philosophy, it is said that Death is the only certainty in Life. It’s inevitable. Be that it is. Death of a person brings sorrow and practical problems to his/her relatives, friends, kith and kin. Law takes care of the interests of the deceased and legal heirs/representatives of the deceased. However, the situation is totally different when one is constrained to presume Death or in other words Death in Absetntia i.e. when a person vanishes or disappears or is unheard of without a trace of his body in  Air crash or at Sea or at War or in natural calamities like Earthquake or Kedarnath flood tragedy or Chennai or Mumbai heavy rains where many people lost their lives  few years back. व्यक्ति बेपत्ता असेल तर काय आहेत कायदेशीर तरतुदी ?  ऍड. रोहित एरंडे. © एखादी व्यक्ती बेपत्ता असेल तर त्या व्यक्तीच्या कुटुंबीयांना अनेक समस्यांना सामोरे जावे लागते. ह्या संबंधातील ' अपुऱ्या ' कायदेशीर तरतुदी काय आहेत ह्याची थोडक्यात माहिती घेवू. हरविलेला भाऊ किंवा नातलग एखाद्या नाट्यमय घटनेनंतर गायब होतो आणि अनेक वर्षांनंतर अवतीर्ण होतो तो हिंदी चित्रपटातच, पण वास्तवात मात्र फार क्वचितच असे घटते आणि त्या बेपत्ता व्यक्तीचे नातलग मात्र संभ्रमात राहतात. शिवाय या बाबतीत कायदेशीर प्रश्न निर्माण होतात ते वेगळेच. *बेपत्ता व्यक्ती 'मृत' घोषीत करण्यासाठी त्या व्यक्तींबद्दल ७ वर्षे काहीही माहिती नाही, हे सिद्ध करावे लागते.* एखादी व्यक्ती खूप दिवसांपासून बेपत्ता असेल किंवा पूर, भूकंप सारख्या नैसर्गिक आपत्तींमध्ये सापडून ज्यांचा काहीच थांगपत्ता लागत नाही, अशा वेळी त्या बेपत्ता व्यक्तींना मृत मानायचे की नाही असा यक्षप्रश्न उभा राहतो. कारण अशा बेपत्ता व्यक्तींचे मृतदेह न मिळाल्याने त्यांना लौकिकार्थाने मृत मानणे आप्त स्वकीयांना क्लेशकारक जाते. परंतु त्याचबरोबर अशा बेपत्ता व्यक्तींच्य
