 It is said that death is certain, but it's time is most uncertain. We have been experiencing in these days Corona Days.

The Corona Warriors like Doctors, Nurses,Staff, Police etc, who are continuously doing Covid Duty also should pay attention to it..

As a lawyer, it's our common experience that many a times the spouse ( yes, the wives are ahead ) is not aware about his/her partner's details like Bank accounts, Bank passwords, how to operate digital banking,  policies, etc..etc .and even Phone Password too.

Whenever the question of Succession Certificate arises, if it's a widow- applicant, most of the time she's now aware the details of movable-immovable properties of her decessed husband.

This scenario must change. Gone are the days when husband- wife hardly knew anything about each other's bank and financial details..


*The time has come to write it down all such details and to share with each other*. 

All these things revolve around money and money plays very important role.

It's a matter of 'Trust' which is the foundation of any relationship.

The Will of any person would include all such details, but still there is a taboo to word " Will". Actually Will is the most effective and comparatively less expensive Deed to be made in case of one's property. The following blog is an attempt to know the alw relating to Will, in nutshell.

*Have 'either or survivor' bank account, than a joint bank account*.

Either or Survivor account means whovery survives gets all the amoonty. Whereas in case of Joint account holders, all get equal rights. So if one out of two holders dies, then the deceased holder's share would devolve as per law of Succession or as per Will.

So if you have not made the changes, do change account operation to either or Survivor.


So start working on it ASAP.

बक्षीस पत्र (Gift Deed)  - महत्वाचा दस्त ऐवज ऍड. रोहित एरंडे © लोकांच्या जिव्हाळ्याच्या असेलल्या ह्या दस्ताबद्दल आपण माहिती करून घेवू.. खरेदी-खत, हक्क-सोड पत्र , मृत्यूपत्र  ह्यांच्याबरोबरच बक्षीस पत्र म्हणजेच "गिफ्ट डिड" हा मिळकतीमधील  मालकी हक्क तबदील  करण्याचा एक लोकप्रिय दस्तऐवज  आहे.  ह्यामधील मृत्यूपत्र सोडता इतर सर्व दस्तांची अंमलबजावणी ही संबंधित व्यक्तींच्या  हयातीत होते. बहुतांशी वेळा जवळच्या नात्यामध्ये प्रेमापोटी, आपुलकीपोटी  केला जाणाऱ्या ह्या दस्ताबद्दलच्या कायदेशीर तरतुदी ह्या ट्रान्सफर ऑफ प्रॉपर्टी ऍक्ट च्या कलम १२२ ते १२६ मध्ये अंकित केलेल्या आहेत. त्याची थोडक्यात माहिती खालीलप्रमाणे १. स्वतःच्या मालकिची आणि 'अस्तित्वात' (existing) असलेली स्थावर किंवा जंगम मिळकत बक्षिस पत्राने तबदील म्हणजेच ट्रान्सफर  करता येते. थोडक्यात  जी गोष्ट अस्तित्वात नाही तिचे बक्षीसपत्र करता येत नाही. २.  बक्षीस पत्र लिहून देणाऱ्या व्यक्तीस  "डोनर" (दाता ) तर ज्याच्या लाभात ते लिहून दिले जाते त्या व्यक्तीस "डोनी" (लाभार्थी) असे म्हणतात.

 हक्क सोड पत्र (Release Deed) - एक महत्त्वाचा दस्तऐवज. :  ऍड. रोहित एरंडे. © "नावावर जागा करणे" किंवा "७/१२ वा  प्रॉपर्टी कार्डला नाव लावणे" या बाबतीत अनेक लोकांमध्ये गैरसमज दिसून येतात. बहुसंख्य लोकांना असे वाटत असते की, ७/१२ च्या उताऱ्याला किंवा   प्रॉपर्टी कार्डला नाव लागले की  आपले नाव लागले  की आपण मालक झालो आणि नाव गेले कि आपला मालकी हक्क गेला. वस्तूथिती मात्र उलटी आहे.  अश्या उताऱ्यांनी मालकी हक्क ठरत नाही.  आपल्याकडे एखाद्या मिळकतीमध्ये मालकी हक्क हा कुठल्याही २ किंवा अधिक  व्यक्तींच्या हयातीमध्ये  खरेदीखत, बक्षीसपत्र, हक्कसोड पत्र, वाटप-पत्र यांसारख्या नोंदणीकृत दस्तानेच तबदील केला जाऊ शकतो.  हे  दस्त कायद्याने नोंदविणे गरजेचे आहे आणि त्यावर योग्य ते मुद्रांक शुल्क म्हणजेच स्टॅम्प ड्युटी आणि नोंदणी शुल्क भरणे गरजेचे असते. त्याचप्रकारे एखाद्या व्यक्तीच्या मृत्यूनंतर मिळकतीमधील मालकी हक्क हा मृत्यूपत्राने किंवा वारसा हक्काने  तबदील होऊ शकतो.  ह्या दस्तांमधील "हक्कसोड पत्र" किंवा ज्याला इंग्रजीमध्ये "रिलीज डीड" म्हणतात ह्या

  फ्लॅटमध्ये  होणाऱ्या  पाणीगळतीचा  खर्च कोणी करायचा ? ..  ऍड. रोहित एरंडे. © सोसायटीमधील फ्लॅट मध्ये बाजूच्या भिंतींमधून किंवा सर्वात वरचा फ्लॅट असेल, तर गच्चीमधून  , विशेषतः पावसाच्या दिवसांमध्ये, होणारी पाणी गळती कोणी दुरुस्त करायची आणि त्याचा खर्च कोणी करायचा हा ज्वलंत प्रश्न असतो.   ह्या संबंधी सोसायटी बाय लॅ।ज -उपनियम  मधील तरतुदी आणि २ महत्वपूर्ण निकाल ह्यांची थोडक्यात  माहिती आपण घेऊ.  सोसायटीच्या दुरुस्त उपनियम १५९ मध्ये सोसायटीने  दुरुस्तीचे आणि देखभालीची कुठले कुठले खर्च करणे गरजेचे आहे, त्याची यादी दिलेली आहे. ह्या मध्ये सर्व प्रकारच्या पाण्याच्या गळत्या ज्यामध्ये पावसाच्या होणाऱ्या गळत्या आणि बाहेरील सामाईक पाईप तसेच मलनिःस्सारण वाहिनीमधून होणाऱ्या गळत्या ह्यांचा देखील समावेश होतो. तसेच पावसामुळे  गच्चीमधून होणाऱ्या गळतीमुळे टॉप फ्लॉवर फ्लॅटचे छत तसेच त्यावरील प्लास्टर खराब होणे, ह्या खर्चाचा समावेश होतो,  जो सोसायटीने करणे गरजेचे आहे. हे नियम असून देखील काही वेळा सोसायटीने असे खर्च करण्यास नकार दिल्यामुळे प्रकरणे कोर्ट पर्यंत पोहोचली आहेत.  पहिला निकाल आहे २००६ साली  मा.
